There was a motion to accept the minutes of the April 18th meeting with 2 corrections.  The motion was seconded and accepted with a vote of 4-0-0.

There was a motion to accept the minutes of March 28th meeting with 1 correction.  The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Minor Buffer Zone Activity:  45 Kenwood Circle  
Mr. Kevin Hardiman, a representative of Amec, appeared before the Commission for proposed stormwater management upgrades at this site.  Mr. Hardiman gave the Commission members a detailed overview of the project plans.

He stated that the work will be conducted within a paved parking area and no sediment will be going into the wetland nor will there be any disturbance to the wetland itself.

There will be silt sacks installed in all of the catch basins during construction.

There was a motion to issue a Negative Determination subject to 3 special conditions; the applicant must notify staff when the work begins, when the work is completed and all work must be completed according to the plan.  The motion was seconded and accepted with a vote
of 4-0-0.

Permit Decision:  485 East Central Street – CE159-1042
There a discussion among the Commission members regarding the issuance of Orders of Conditions for this project.

There was a motion that the applicant has satisfied their burden of proof and issue a permit with 65 Orders of Conditions and the changes from the ones sent to us earlier were that the first sentence is order #65, the 2 paragraphs in front of #51 get rolled into 51 and under #55 Success Standard 1;  the 2 citations of 75% be replaced by 90%.  The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1Abstention.


Public Hearing - Notice of Intent – Franklin Innovation Center – 31 Hayward Street –
CE159-1045
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for the construction of 34 parking spaces at this site.  Mr. Nielsen submitted plans for this site and gave the Commission a detailed overview of these plans.  He also provided the Commission with some background information for the site.

Mr. Nielsen informed the Commission that stormwater treatment will be done according to the recommendations of the Town Engineer; riprap is proposed to be placed in the swale.  There will be no disturbance within the 0-25 ft. from the buffer zone.

There will be mitigation with shrubs for habitat enhancement purposes.  

The Commission Chair stated that regarding the 3 species of proposed plantings, the size needs to be bigger; a minimum of 5 gallons for the arrowwood, chokeberry and the dogwood.

A Commission member informed Mr. Nielsen that he has not satisfied his burden of proof.  The functions and characteristics items were reviewed and items questioned at tonight’s meeting.

A Commission stated that the parking spaces are located 80 ft. at their closest point from the wetland to alleviate any confusion in the agent’s report.

There was no one in the audience for this public hearing.

Some special conditions discussed with the applicant were:

        o       Disturbed areas that have exposed soils for longer than 2 weeks shall be stabilized     with temporary mulch.  The temporary mulch shall be removed only for the        purposes of completion of grading and landscaping.

        o       Soils shall be stockpiled on east side of site with erosion controls determined by      the Conservation Agent to be satisfactory.  

        o       Rip rap must be placed at the swale to the north of the existing roadway in a   manner satisfactory to the Town Engineer.

        o       The planting schedule shall be amended to require minimum 5 gallon size shrubs,         e.g. arrowwood, chokecherry and dogwood.  Deciduous tree species shall be       specified as a minimum 2” caliper, and not specified by height.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 4-0-0.

There was a discussion among the Commission members regarding the issuance of Orders of Conditions for this project.

There was a motion that the applicant has satisfied their burden of proof and issue Local and State permits with 29 orders of conditions as typed up by staff with the modifications just discussed.  The motion was seconded and accepted with a vote of 4-0-0.
